Freehold title for NRIs: what you actually own in a branded residence
A titled apartment or villa is a different instrument from a timeshare, a club membership or a share in a platform. This is how the title works for a non-resident buyer, in plain terms.
Non-resident Indians may buy residential property in India, and the purchase is registered in the buyer’s own name under the ordinary property law of the state. A branded residence bought from Fine Acers is exactly that: a registered, freehold residential unit that happens to sit inside an operating resort and to carry a lease back to the operator.
Three things that are yours
- The unit itself, by registered sale deed, with your name on the record.
- The income from the unit under the lease, paid to your Indian account.
- The right to sell, gift or bequeath the unit, subject to the lease that runs with it.
Three things that are not
- The resort’s common areas and the brand: you enjoy them under the agreement, you do not own them.
- The operating decisions: rates, staffing and marketing sit with the operator, which is the point of paying for a brand.
- Unrestricted personal use in peak season: owner nights are defined in the agreement, because every night you sleep in the unit is a night it does not earn.
Why this matters against the alternatives
A timeshare gives you weeks, not title. A club membership gives you access, not an asset. A platform share gives you paper in a vehicle that owns the property; you own the vehicle’s promise. The difference shows up at exactly the moments that matter: when you want to sell, when you want to borrow against it, and when you want to leave it to your children.
The practicalities for a non-resident
Funds move from your overseas account as an inward remittance or through your NRE account. Income credits to your NRO account and, after Indian tax, is remittable under the standing rules. Registration is done in person or through a registered power of attorney.
